Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
This is to inform the market that Clarion Housing Group is looking to contract for Workday Licences and Support and Maintenance.
Workday Limited is the owner of the Intellectual Property Rights (IPR) of the software and is the sole provider of these licences. This will give Clarion Housing Group rights to product upgrades, new product functionalities, fixes, patches directly with Workday Limited for a period of 5 years. Clarion Housing Group is still developing Workday and requires access to all updates.
Our HR and Payroll systems and business operations are based around the Workday software/ system, which has been live for a year. As such there is significant risk involved in the decommissioning of this system. We have undertaken analysis and the whole life cost of changing systems is higher than that of extending our contract with the Workday Ltd, making it unrealistic for an alternative supplier to offer a more competitive proposal than our incumbent.
